MyStoryHisGlory is a digital marketplace that allows users to upload, distribute, and sell music content. We facilitate transactions between content creators ("Sellers") and purchasers ("Buyers").

3. User Accounts

3.1 Account Creation

• You must be at least 16 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Security

• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account information

4. Content Ownership and Rights

4.1 User Representations and Warranties

By uploading content to the Platform, you represent and warrant that:

• You own all rights, titles, and interests in the content, including all copyrights, trademarks, and other intellectual property rights
• You have obtained all necessary permissions, licenses, and clearances from any third parties whose work is incorporated in your content
• Your content does not infringe upon any third-party rights, including but not limited to copyrights, trademarks, patents, trade secrets, or privacy rights
• You have the full legal right and authority to enter into these Terms and to grant the licenses described herein

5. Content Guidelines and Removal Rights

5.1 Prohibited Content

You may not upload content that:

• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is illegal, obscene, defamatory, threatening, harassing, or hateful
• Promotes violence, discrimination, or illegal activities
• Contains sexually explicit material involving minors
• Violates any applicable law or regulation

5.3 No Obligation to Monitor

We have no obligation to monitor content uploaded by users but reserve the right to do so at any time.

6. Sales and Platform Fees

6.2 Payment Processing

• Payments are processed through our third-party payment processors
• Sellers will receive 90% of the sale price after commission deduction
• Payment schedules and minimum payout thresholds will be communicated separately

6.3 Pricing

• Sellers maintain full control over pricing of their content
• Prices must be set in accordance with applicable laws
• We reserve the right to refuse listings with unreasonable or fraudulent pricing

6.4 Refunds and Chargebacks

• Refund policies will be handled according to our separate Refund Policy
• Sellers may be held liable for chargebacks resulting from disputed transactions
• We reserve the right to deduct chargeback fees and disputed amounts from Seller accounts

7. Licenses

7.1 License to Platform

By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Host, store, and display your content on the Platform
• Distribute your content to purchasers
• Use your content for promotional purposes related to the Platform
• Create thumbnails, previews, and other derivative works necessary for Platform operation

7.2 License to Buyers

Buyers receive a license to the purchased content as specified in the individual content listing. This typically includes personal use rights but excludes redistribution or commercial exploitation unless explicitly stated.

8. Intellectual Property

The Platform, including its design, features, code, and trademarks, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform.

9. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to the Platform or other user accounts
• Interfere with or disrupt the Platform's operation
• Upload content containing viruses or malicious code
• Engage in any form of automated data collection (scraping, bots, etc.)
• Manipulate sales rankings or reviews
• Create multiple accounts to circumvent restrictions

10. DMCA and Copyright Complaints

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please submit a DMCA takedown notice to support@mystoryhisglory.online including:

• Your contact information
• Description of the copyrighted work
• Location of the infringing content
• A statement of good faith belief
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

11. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Content uploaded by users is accurate or lawful

12. Limitation of Liability

Our total liability shall not exceed the amount of fees paid by you to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Platform, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your content uploaded to the Platform
• Your use of the Service

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using account settings.

14.2 Termination by Us

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Fraudulent, illegal, or harmful activity
• Extended periods of inactivity
• Any reason at our sole discretion

14.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your content and account data
• Outstanding payments owed to you will be processed according to our payment schedule
• Sections that by their nature should survive termination will remain in effect

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
